1. The essentials
A summary in plain language. It makes reading easier, but it does not replace the full text below.
- BotHub is an automation platform: robots run the routines you set up, on the websites and systems you choose, using the credentials you store in the vault (the protected area of your account).
- Every run has a real effect on the website or system where the robot works, including during the free trial. The decisions and obligations tied to each task belong to your company.
- BotHub provides the tool. The automations you use, including catalog automations, are your responsibility, and checking whether each website or system allows access by robots is always up to you.
- Third-party websites and systems change without notice. We do not control them and do not guarantee that they will work at all times.
- New accounts get 100 free runs after confirming their email address, with no card required.
- Plans are monthly and renew automatically. You are charged by card through Stripe (the company that processes payments), after each month's usage. You can cancel whenever you want, and you can withdraw from a subscription within 7 days of subscribing without paying anything for that period.
- For the data you put into tasks, your company decides and BotHub carries out the work, as provided by the LGPD (Lei Geral de Proteção de Dados Pessoais, Brazil's General Data Protection Law).
- We are liable for BotHub's own failures, as required by law. When we have to pay compensation for damage, the amount is limited to the total you paid or owe BotHub for the 6 months before the event that caused the damage. We are not liable for incorrect data you provide, for errors or defects in the automations you use (including catalog automations), for failures or changes in third-party websites and systems, or for events nobody can foresee. If you are a consumer, which may include small businesses and individual microentrepreneurs (MEIs), your rights under the CDC (Código de Defesa do Consumidor, Brazil's Consumer Protection Code) still apply, and the limit applies to the extent the law allows. See the Limitation of liability section.
- Sections marked "Read carefully" limit rights or set out important rules.
2. About us and acceptance
These Terms of use govern the use of BotHub, an automation platform operated by SYSMJM TECNOLOGIA LTDA, a company registered with the CNPJ (Cadastro Nacional da Pessoa Jurídica, Brazil's national registry of legal entities) under no. 56.989.396/0001-04. In this document, "BotHub", "we" and "us" refer to that company, and "you" refers to whoever creates the account and uses the platform.
You accept these terms by ticking the acceptance box when you sign up or by continuing with Google. By accepting, you also confirm that you have read the Privacy policy, which explains how we handle personal data.
We keep a record of your acceptance: the version of these terms, the date, the time and the IP address (the number that identifies your internet connection). This record serves as proof of the contract, for you and for us.
If you use BotHub on behalf of a company, you confirm that you have the authority to accept these terms for it. In that case, "you" includes that company, which is responsible for the use of the account.
To reach us, write to [email protected]. Matters about personal data have their own channel: [email protected].
3. Key terms
Some terms appear several times in this document. Here is what they mean:
- Automation: the sequence of steps the robot follows on a website or system, such as signing in, filling in, checking, sending and downloading.
- Routine: the day-to-day process in your company that the automation carries out, such as downloading documents every week or entering orders into a system.
- Task: each request for an automation to run with a set of data, made from the dashboard, a spreadsheet (one task per row), a schedule or the API.
- Run: each time the robot carries out a task, until it finishes or stops on an error.
- Counted run: the unit used for the free trial and for plan billing. Every run that finishes without an error counts once, including a partial run, as explained in the Plans, runs and payment section.
- Robot: the program that opens the website or system and carries out the steps of the automation, on a BotHub machine or, when available, on your own computer.
- Target system: the third-party website or system where the robot works, such as a public portal, a bank, a supplier's website or an ERP (the company's management system).
- Dashboard: the area of BotHub you sign in to with your account to set up automations, follow your usage and download results.
- Vault: the area of your account where the passwords, keys and other credentials the robot uses are stored encrypted (in coded form). For a digital certificate, the vault may hold the address of the file and its password, and the robot downloads the file when the task runs.
- Catalog: automations built for BotHub customers and made available on the website and in the dashboard for anyone to use.
- Custom automation: an automation built by our team for a specific process in your company.
- API, token and webhook: the API is the door your system uses to talk directly to BotHub; the token is the key to that door; the webhook is the address on your system that receives the result of each run.
- Consumer: whoever hires BotHub as the end user of the service, as defined by the CDC. The law may also treat a business as a consumer, for example an individual microentrepreneur (MEI) or a small business that hires BotHub without the technical knowledge to assess the service.
4. What BotHub does and does not do
Read carefully
BotHub provides the tool: robots that run routines on third-party websites and systems, as each routine was set up and with the data you provide. Some examples: downloading documents from portals, entering orders into an ERP, filling in forms from a spreadsheet, running batch lookups and issuing documents on public systems.
You can run an automation from the dashboard, from a spreadsheet, on a schedule or through the API. Every run is recorded in BotHub with its status and result. In the dashboard, you can follow the totals and download the results of your spreadsheets; through the API and the webhook, your system receives the result of each run.
BotHub does not:
- provide accounting services or tax, legal, labor or financial advice;
- decide for you what to do, for whom or with which data;
- check whether an operation is correct or the best one for your business;
- take responsibility for the automations you use, whether you created them, our team built them at your request or you chose them from the catalog, except in the cases explained in the Limitation of liability section, or check whether the target websites and systems allow access by robots;
- serve as an archive for your documents: download and keep the results you need;
- have any connection with the owners of the websites and systems where the robot works, or speak on their behalf.
Runs take place on BotHub's robots or, when this option is available for your account, on a robot installed on your computer. In that case, the run data passes through your computer, and keeping that computer and your network secure is your responsibility. Failures in the robot program itself remain our responsibility. The installed robot is part of the service and may only be used with your account, while the account is active.
5. Account and access
To use BotHub, you need an account, created with a name, email address and password or with Google sign-in. The information you register must be accurate and kept up to date.
- You must be at least 18 years old and legally able to enter into contracts. BotHub is a service for businesses and professionals, not for children or adolescents.
- Confirm your email address using the link we send you. If a new account's email address has never been confirmed and the account has nothing stored in it yet (vault, schedules or automations), the account may pass to whoever proves, by signing in with Google, that they own that address.
- Keep your password safe and do not share it. You are responsible for anything done with your login, unless the problem comes from a failure on our side.
- Access tokens work like a password and need the same care.
- If you suspect someone is misusing your account, change your password and let us know at [email protected].
Authorized members of our team may access your account to provide support, investigate errors, protect the platform and comply with the law, always under a duty of confidentiality.
6. Authorization for the robot to act on your behalf
Read carefully
To do the task, the robot signs in to the websites and systems you set up and acts on your behalf, or on behalf of the company you represent. To do so, it uses the credentials you stored in the vault, such as passwords, keys, access codes and the details of your digital certificate.
By setting up and running an automation, you authorize BotHub to use those credentials to run the configured routines on those websites and systems, and only those routines. The authorization applies to each automation while it is in use and can be withdrawn at any time.
As far as the websites, systems and public authorities are concerned, you are the one acting: the robot is a tool you use to run your routines. BotHub does not become your legal representative (it does not act for you under a power of attorney) and does not decide anything for you.
By giving this authorization, you confirm that you:
- have the right to use each credential you store in the vault and to authorize the robot to use it, because it is yours or because its holder has authorized you;
- check the terms of use of the websites and systems where each routine runs, including when you use a catalog automation, and do not automate a system that prohibits access by robots. BotHub does not do this check for you;
- provide correct and complete data, through the dashboard, a spreadsheet, a schedule or the API;
- have a legal basis, that is, a reason accepted by the LGPD (such as a contract with the person or a legal obligation), to use the personal data of other people that you put into tasks, such as data about customers, suppliers or employees.
To withdraw the authorization, delete the automation's schedules and ask us to remove the credential from the vault by writing to [email protected]. The withdrawal takes effect when we receive your request: we stop using that credential, including in tasks waiting in the queue. Changing the password in the system itself is an extra safeguard we recommend.
If the credential is a digital certificate, also ask us to remove it from the robots' computers, where it may have remained installed after the tasks, as explained in the Privacy policy.
If a credential is changed or stops working, the runs that depend on it end in an error until you update the vault.
7. Who decides and checks the result
Read carefully
BotHub carries out the work; you make the decisions. Decisions about what to do, for whom and with which data, as well as the legal, tax, labor, contractual and regulatory obligations tied to each routine, remain with your company.
The robot follows the setup and the data you provide. It does not assess whether an operation is correct, whether it is the best one for your business or whether it complies with the rules of the target system.
Every run has a real effect on the target system: the robot may actually send, enter, issue, change or cancel something. Before leaving a routine to run on its own, and whenever you change something in it, check the input data and the first results.
When a run fails because of a temporary problem, the robot may try again on its own, up to 3 times, at intervals of 30 minutes to an hour and a half. As a result, a task may finish hours after it was sent. If it should no longer run, write to [email protected] and we will cancel it (if you use the API, you can also cancel it there).
Correcting or undoing an action taken on the target system is up to you, within the deadlines and rules of that system.
None of this removes our liability, within the limits of the Limitation of liability section, when the robot does something different from what was set up, when an automatic retry repeats an action the robot had already taken, or when the result delivered is wrong because of a failure in the platform or in the robot program itself.
8. Third-party websites and systems change
Read carefully
The websites and systems where the robot works, such as public portals, banks, ERPs and supplier websites, belong to third parties. They can change, slow down, ask for new verifications, block access by robots or go offline without notice. BotHub does not control these systems.
When the robot does not find on the screen what the automation expects, the run stops with an error instead of carrying on by guesswork. A run that ends in an error before the main step of the routine is not charged, as explained in the Plans, runs and payment section.
Maintenance of the custom automations our team builds follows what the proposal or contract sets out. The automations you create or adjust yourself in the editor, or that someone else creates for you, are yours to look after, including their maintenance.
If we adjust an automation you use, we keep what it does on the target system. If the adjustment alters what the automation does, for example if it starts sending, confirming or changing something it did not do before, we let you know at the email address on your account, and the automation only starts doing that new step after you confirm by replying to our email. Until then, it keeps working as before or is paused.
We do not guarantee that a third-party system will work at all times or that it will keep allowing access by robots. Checking that it still does is up to you, including for catalog automations. If a system stops allowing it, the automation may be discontinued, as explained in the Suspension and termination section.
9. Artificial intelligence, captcha and other services
Some automations use third-party services for specific steps: artificial intelligence, to read and interpret text, documents and images, and captcha solving (a captcha is the "I'm not a robot" test some websites use to check whether the visitor is a person).
When a website asks for this check, the robot solves it in order to do, in your place, the step you would do by hand with your own credentials. This does not allow you to use BotHub to access anything you are not authorized to access.
Artificial intelligence can make mistakes. When an automation relies on what it reads, check the results, especially in the first runs. These services only carry out the requested step and make no decisions about you or about other people.
To access some websites, the robot may also use third-party connection services (a proxy, an intermediary between the robot and the website).
Some extra features may be charged separately, only when used, such as artificial intelligence, captcha solving and proxy connections. Their use is itemized in your dashboard statement. The third-party services BotHub uses are described in the Privacy policy.
The price of each extra feature depends on the service provider, so it is available on request: ask us at [email protected]. An extra feature is only charged after we have told you its price in writing and you have agreed to it, before its first use. Changes to that price follow the same 30-day notice rule as in the Plans, runs and payment section.
10. Free trial
Read carefully
New accounts get 100 free runs to try BotHub before choosing a plan, with no card required.
- The free runs are unlocked once you confirm your email address. Anything sent before the confirmation does not use the free runs and waits for a plan.
- Each email address is entitled to a single free trial, including variations of the same address, such as [email protected] or, for Gmail, [email protected], which count as the same address.
- Each run that finishes without an error uses up one free run, including a partial run (see the Plans, runs and payment section). A run that ends in an error before the main step of the routine does not. To prevent abuse, the trial accepts at most 150 tasks in total, counting those that succeeded, those that ended in an error and those that were canceled.
- Trial runs are real: on the target system, the robot does exactly what it would do on a paid plan, with the same effect.
- Artificial intelligence and captcha used during the free runs are not charged.
- Once the free runs are used up, new tasks wait until you choose a plan. When you subscribe, the tasks that were waiting run right away, with real effect. Before subscribing, check those tasks. If any of them should no longer run, write to [email protected] before subscribing and we will cancel it. If you use the API, you can also cancel it there.
- The free runs are valid until you subscribe to a plan. Any remaining balance does not carry over to the plan.
- The trial does not turn into a subscription on its own: nothing is charged unless you choose a plan.
Some anti-abuse checks, such as the one-trial-per-email rule, are automatic and may leave an account without the free runs. If you think this was a mistake, write to [email protected] and a member of our team will review your case.
11. Plans, runs and payment
Read carefully
The plans, the monthly minimum of each one and the price of runs per usage tier are on the pricing page. The price published when you subscribe applies until it changes with the notice described below.
Every run that finishes without an error counts once, whether it was started from the dashboard, a spreadsheet, a schedule or the API. This includes a partial run, in which the robot does part of the routine and returns what it managed to do. A run that fails after the robot has already done the main step of the routine, such as sending or issuing something, also counts as partial, because that step has already had a real effect. A run that ends in an error before that step is not charged.
If a run was charged but ended without a useful result because of a failure in the robot itself, you can ask for a refund of that run by writing to [email protected].
Payment is made by card through Stripe, the company that processes our payments. Your card number is entered in Stripe and is not stored by us.
The subscription is monthly and renews automatically until you cancel. Usage for each calendar month (from the 1st to the last day) is added up and charged to your card after the month ends. Every month, you pay at least your plan minimum. If the runs and the extra features used in the month add up to more than that minimum, you pay that total. In the month your subscription starts or ends, the minimum is prorated to the days you were subscribed in that month.
The amounts show up in your dashboard statement. You can ask to change plans in the dashboard, and the change applies from the following month.
- Price changes: we notify you by email at least 30 days in advance. The new price only applies to usage from the first month that starts after that period and never changes the price of a month that has already started. If you do not agree, you can cancel at no cost before the new price takes effect.
- Declined payment: new tasks may wait until the payment is settled. Once it is settled, the tasks that were waiting run right away, with real effect. Check those tasks beforehand. If any of them should no longer run, write to [email protected] and we will cancel it (if you use the API, you can also cancel it there). If the situation continues, the Suspension and termination section applies.
- Billing errors: if you think you were charged by mistake, write to [email protected]. Once we confirm the charge was wrong, we refund it through Stripe, with monetary adjustment, as provided by the CDC.
12. Cancellation and end of the contract
You can cancel your plan at any time, with no penalty and no need to give a reason, in one of these ways: in the dashboard, under Financeiro (Billing), the "Gerenciar cartão e faturas" (Manage card and invoices) button opens the Stripe portal, where you can cancel, see your invoices and change your card; or by email, writing to [email protected].
Your request takes effect on the date we receive it, whichever way you use, even if our confirmation arrives later. In the Stripe portal, the confirmation appears on the screen itself. By email, we confirm by replying to your message.
After the request, the subscription runs until the end of the current subscription period, which renews every month on the day you subscribed. Until then, your account keeps working as usual and whatever runs counts as usage. There may be a final charge, with the minimum prorated to the days you were subscribed in the last month and the usage up to the end of the subscription. After that, nothing else is charged.
If you do not want to use anything else until the subscription ends, delete your schedules and do not send new tasks.
After the subscription ends, new tasks are no longer run and wait for a plan. Before that, download the results of your spreadsheets in the dashboard. For other results, use the API or ask for a copy by writing to [email protected].
Account and task data follow the retention and deletion rules in the Privacy policy. You can ask for deletion by writing to [email protected].
13. Right of withdrawal
You may withdraw from a plan subscription within 7 days of the date you subscribed, as provided by the CDC (art. 49). This right applies to all BotHub customers.
To withdraw, write to [email protected] within 7 days of subscribing. You can also cancel under Financeiro (Billing), using the "Gerenciar cartão e faturas" (Manage card and invoices) button: we check cancellations made in the first 7 days of a subscription and treat them as withdrawals. As soon as we identify the request, we end the subscription, new tasks are no longer run and we confirm by email.
If you write from another address, we may ask for a simple confirmation that the account is yours, and the period is counted from the date of your first message.
When you withdraw, we charge nothing for that subscription, not even the runs and extra features used up to then. If any amount has already been charged, we ask Stripe for the refund right after receiving your request, and how long it takes to show on your card statement depends on the bank that issued the card.
Withdrawing does not undo what the robot has already done on the target systems during those days.
If you ask to move to a bigger plan, you can withdraw from that change within 7 days of the request, by writing to [email protected], and stay on your previous plan without paying the difference.
14. Custom automations and separate contracts
Custom automations, integrations with negotiated terms and other services hired through a proposal follow the proposal or the signed contract. Where they differ, the proposal or contract prevails over these terms. Where they are silent, these terms apply.
These contracts may have other payment methods, deadlines and maintenance rules. Ownership of anything developed under them is set by the proposal or contract.
15. API, tokens and webhooks
The API lets your system create runs and check results without going through the dashboard. Runs created through the API count like any other run.
- Access tokens work like a password. Keep them somewhere safe and do not put them in public code or in messages.
- If a token leaks, revoke it in the dashboard (under API > Tokens, for accounts with API access) and create a new one. If you need help, write to [email protected].
- We may invalidate a token that appears to be compromised or that is being used in breach of these terms. When this happens, we let you know by email.
- Use the API without trying to get around the platform's technical limits.
- When you provide a webhook address, we send the result of each run to it. The security of that address, and of who has access to it, is your responsibility.
- Some results include links to files downloaded by the robot. These links do not require signing in: treat them as confidential and do not pass them on to anyone who should not see the files.
When a change to the API could break integrations, we let you know in advance whenever possible.
16. Acceptable and prohibited use
Read carefully
Use BotHub only for lawful purposes, with credentials you have the right to use. You may not use BotHub to:
- commit fraud, forge documents or act on behalf of someone who has not authorized it;
- access systems, accounts or data without authorization, test passwords in bulk or use someone else's credentials without their permission;
- unlawfully get around access or security controls, or use the robot on a system whose rules prohibit that use;
- collect or process personal data without a legal basis, including in bulk;
- send unsolicited bulk messages (spam), impersonate someone else or violate the rights of others;
- overload or attack BotHub or the systems where the robots work;
- create or run automations that contain malicious code or that try to access other customers' data, platform secrets or the machines the robots run on;
- break the usage rules of the artificial intelligence and captcha services used by the automations;
- create multiple accounts to get the free trial again;
- resell or pass on access to the platform without an agreement with BotHub.
We may review, pause or block an automation, a run or a token that puts the platform, other customers or third parties at risk. Where there are signs of a crime, we may preserve records and comply with orders from the authorities, as required by law.
17. Suspension and termination
Read carefully
We may suspend tasks, automations or the account in case of:
- a declined payment that has not been settled;
- prohibited use, a serious breach of these terms or a breach that is not corrected after our notice;
- a risk to the security of the platform, other customers or third parties;
- false registration data;
- an order from a competent authority.
Whenever possible, we let you know beforehand at the email address on your account and explain why. In case of a security risk or a legal order, the suspension may be immediate, and we let you know right afterwards, when the law allows.
A suspension, on its own, does not delete anything. Once the reason is resolved, for example by bringing payments up to date, the account works as before.
During the suspension and until any termination, you can ask for a copy of the results of your tasks by writing to [email protected], except while the security risk lasts or to the extent a legal order prevents it.
If the reason is not resolved within 30 days, we may close the account, with prior notice by email. After the account is closed, you still have 30 days to ask for a copy of the results. After that, the data follows the Privacy policy.
You can close your account whenever you want: cancel your plan and ask for deletion by writing to [email protected].
A catalog automation may be discontinued. If the reason is that the target system stops allowing access, we let you know as soon as we find out. In other cases, we give you at least 30 days' notice.
If we decide to shut down BotHub or a part of it that you use, we give you at least 30 days' notice and time to download your data. We charge nothing for the remaining time and refund anything paid for a period not used.
18. Personal data: who decides what
BotHub processes personal data (collects, stores, uses, shares and deletes it) in accordance with the LGPD (Law No. 13,709/2018). The details are in the Privacy policy, which complements these terms.
For your account data, such as name, email address, billing, acceptance and security logs, BotHub is the controller: it decides how and for what purpose this data is used, within the law.
For the data you put into automations, your company is the controller and BotHub is the processor (operador, under the LGPD), meaning the party that processes the data on your company's behalf. This includes input data, spreadsheets, vault credentials, verification codes, results, run history and the data of other people that appears in the tasks.
19. How we look after your task data
For task data, this section serves as the data processing agreement between your company and BotHub (LGPD, art. 39). As processor, we undertake to:
- process the data of the people connected to your company that you put into tasks, such as customers, suppliers and employees, for as long as the contract lasts and for the retention periods described in the Privacy policy;
- process this data only to run the configured routines, deliver the results (in the dashboard, through the API or to the webhook you provide), provide support, protect the platform and comply with the law. The setup of the automations and these terms are your instructions;
- not sell this data or use it for marketing or for other purposes of our own;
- let you know if we believe an instruction breaks the law. In that case, we may decline to carry it out;
- keep this data confidential, require confidentiality from our team members and list, in the Privacy policy, each provider and what it receives;
- adopt technical and administrative security measures suited to the service, described in the Privacy policy;
- engage other companies (sub-processors) only for functions of the service, such as hosting, file storage, sending emails, artificial intelligence, captcha and connection networks (proxy), and always under a duty to protect the data. You authorize this by accepting these terms;
- keep a description of the sub-processors in the Privacy policy and notify you by email of relevant changes. If you do not agree with a change, you can cancel;
- provide, at your request, the information needed about the transfer of data to other countries carried out by some of these services;
- forward to you the requests from data subjects (the people the data refers to) about the data in your tasks, and help as far as we can;
- notify you as soon as possible after confirming a security incident involving this data, telling you what we know: what happened, the data affected, the approximate number of people and the measures taken;
- keep the history of each run, including which websites the robot accessed at your request, to show the result, investigate errors and protect the platform;
- when the contract ends, let you obtain the results (through the result spreadsheet in the dashboard, through the API or by asking for a copy at [email protected]) and, when you ask, delete the task data stored in BotHub, except for what the law requires us to keep. Technical copies, such as the logs on the robots' computers, follow the retention periods in the Privacy policy.
With this notice, your company assesses whether it needs to report the incident to the ANPD (Agência Nacional de Proteção de Dados, Brazil's National Data Protection Agency) and to the people affected.
We are liable as processor when we breach the LGPD or your instructions. To check that we comply with this section, ask for the information by writing to [email protected].
20. Your company's duties regarding this data
As the controller of the data it puts into tasks, your company undertakes to:
- have a legal basis for each use of personal data in the automated routines;
- inform the people whose data it uses, when the law requires, and respond to their requests;
- put into tasks only the data the routine needs;
- include sensitive data (such as health, biometrics, racial origin or religion) or data about children and adolescents only when it is essential and there is a legal basis, and talk to us before automating routines that process this data on a regular basis;
- keep passwords and other credentials only in the vault, and never in text fields, spreadsheets or file names;
- report incidents that must be reported to the ANPD and to the people affected, with our support.
21. Intellectual property
The platform, the robots, the editor, the catalog automations, the BotHub brand and the content of the website are protected by law. These terms do not transfer any rights over them to you.
While your account is active and you comply with these terms, you may use BotHub in your routines, on a non-exclusive basis and without the right to transfer this permission. You may not copy, modify or try to extract the code of the platform, the robots or the catalog automations, except where the law allows it, nor resell access.
Your data, files, credentials and the results of runs belong to you, or to whoever holds the rights to them. BotHub uses them only to provide the service, give support and comply with the law.
In the automations you create in the editor, the setup and the content you added are yours, and the editor and the platform components remain BotHub's. You authorize BotHub to store and run these automations for as long as the account exists. An automation of yours only goes into the catalog with your express authorization.
Custom automations follow what the proposal or contract says. Suggestions you send us may be used to improve BotHub, with no obligation to pay for them.
22. Availability and support
We work to keep BotHub online, but we do not guarantee uninterrupted operation or any minimum level of availability. The platform may stop because of failures, maintenance or problems with third-party services.
If BotHub is offline for a significant period because of a failure on our side, you can ask, by writing to [email protected], for a proportional reduction of that month's minimum.
When planned maintenance affects use, we let you know in advance whenever possible.
Support is provided by email, at [email protected]. We do not offer 24-hour support or a guaranteed deadline for fixing automations.
23. Limitation of liability
Read carefully
We are liable for damage caused by the service, as required by law, within the limit explained below. We are not liable when the damage results from:
- incorrect or incomplete data provided by you, through the dashboard, a spreadsheet, a schedule or the API;
- setup you did yourself, or decisions you made based on the results, unless the result was wrong because of a failure in the platform or in the robot program itself;
- errors or defects in the automations you use (those you create, catalog automations and custom automations our team builds at your request), unless the failure is in the platform or in the robot program itself, or an automatic retry repeats an action the robot had already taken;
- failure, change, blocking or unavailability of the third-party websites and systems where the robot works, including when they do not allow access by robots, unless the failure is in the robot program itself or an automatic retry repeats an action the robot had already taken;
- use of your account by someone who obtained your password or tokens without any failure on our part;
- external events that nobody can foresee or prevent and that have nothing to do with how BotHub works (force majeure, called caso fortuito ou força maior in Brazilian law), such as natural disasters.
When we have to pay compensation for damage, the total amount is limited to what you paid or owe BotHub for the 6 months before the event that caused the damage. This limit applies to all customers. It exists because the price of each counted run is low and the service depends on third-party websites and systems that BotHub does not control.
If you are a consumer (see what this means in the Key terms section), your rights under the CDC still apply, and the limit above applies to the extent the law allows.
A proposal or separate contract may set a different limit. In that case, what it says applies.
The limit and the cases above in which we are not liable do not apply to damage caused intentionally (willful misconduct) or through gross negligence (serious carelessness), or to anything the law does not allow to be limited or excluded.
24. Changes to these terms
Read carefully
We may update these terms to keep up with changes in the service or in the law. Each version has a number and a date, shown at the top of this page.
When a change is significant, we let you know at the email address on your account at least 30 days in advance and explain what changed. Changes required by law or for security reasons may take effect sooner, and we let you know as soon as possible.
If a change reduces your rights or increases costs, we ask for your new acceptance before the new version applies to your account. Until you accept it, the previous version keeps applying to your account. If you do not accept it by the date given in the notice, we may end the subscription at the end of the current period, at no cost to you, after a further notice by email.
For other changes, if you do not agree with the new version, you can cancel your plan at no cost before it takes effect. Wording corrections that do not change rights may be made without notice.
We keep every version of these terms. If you need the version you accepted, ask for it by writing to [email protected] and we will send you a copy.
25. Communications
We contact you at the email address on your account: notices about your account, the free trial, payments, changes to these terms and incidents. Keep that email address up to date and check your spam folder too.
BotHub emails are sent from @bothub.bot addresses. Receipts and invoices may come from Stripe. Be wary of messages in BotHub's name sent from other addresses.
Messages exchanged by email count as communication between us. To reach us, use [email protected]; for personal data matters, [email protected].
26. Other rules
- These terms and, where applicable, the proposal or separate contract form the agreement between you and BotHub. The Privacy policy explains how we handle personal data.
- If any clause of these terms is held invalid, the others remain in force.
- Not enforcing a rule at some point does not mean waiving it.
- You may not transfer your account or these terms to another person without our consent. We may transfer this contract to a company that takes over the service, with your rights preserved. We let you know in advance at the email address on your account, and you can cancel at no cost if you do not agree.
- This English version is a translation. If it differs from the Portuguese version, the Portuguese version prevails.
27. Governing law and where to go to court
These terms are governed by Brazilian law.
If you are a consumer, you may bring a claim in the courts of the city where you live, as guaranteed by the CDC. You may also contact Procon, the consumer protection agency of your city or state.
In cases that are not consumer relationships, the parties choose the courts of Pinhais/PR, the city where SYSMJM TECNOLOGIA LTDA has its head office, to settle any matter about these terms.
Before taking any other step, write to us at [email protected] so we can try to resolve the matter. This step is optional and does not stop you from enforcing your rights.
